... Respondent ABDUL QUDDHOSE.J., A joint endorsement has been made by both the counsels, on instructions, that the parties are agreeing for the appointment of Hon'ble Mr.Justice K. Ravichandra Babu (Retd.) as the sole arbitrator to adjudicate the dispute between the parties arising out of works contract dated 17.02.2024.

2. The learned counsel for the applicant would also submit that in so far as the interim relief sought for before this Court is concerned, liberty may be granted to the applicant to file a similar interim application before the arbitrator under Section 17 of the Arbitration and Conciliation Act.

3. In view of the joint endorsement made by both the counsels, on instructions, Arb. Appln. No.792 of 2024 is disposed of by issuing the following directions:

a) Hon'ble Mr.Justice K. Ravichandra Babu (Retd.) is appointed as the sole arbitrator to adjudicate the dispute between the parties arising out of the works contract dated 17.02.2024;

ABDUL QUDDHOSE.J., ab (b) The Arbitrator shall be paid his remuneration / fees in accordance with the 4th schedule of the Arbitration and Conciliation Act, 1996 or as per the mutual consent of both the parties;

(c) Both the parties shall equally share the arbitrator's fees. (d) The Arbitrator shall conduct the arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 and shall complete the arbitration within the specified time as prescribed under the said Act.

4. In view of the appointment of Hon'ble Mr.Justice K. Ravichandra Babu (Retd.) as the sole arbitrator, O.A.No.871 of 2024 is disposed of by granting liberty to the applicant to file similar interim application before the arbitrator under Section 17 of the Arbitration and Conciliation Act. 12.02.2025 ab Arb.
