This Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 05.11.2024, seeking bail in Crime No.321 of 2024 registered for the offences under Sections 4(1)(a) & 4(1-A) of TN Prohibition Act.

2. The case of the prosecution is that, petitioner was found in illegal possession of 38 Nos. of each 180 ml of brandy bottles. Hence, the case.

3. Learned counsel appearing for the petitioner would submit that, the petitioner is an innocent person and he has been falsely implicated in this case. He would submit that the petitioner is in judicial custody from 05.11.2024. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police while opposing for the grant of bail to the petitioner, would submit that, the petitioner was found in illegal possession of 38 brandy 1/3

bottles. He would further submit that petitioner has 5 previous cases of similar nature and he has been arrested very recently.

5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) appearing for the respondent Police and perused the materials available on record.

6. Taking into consideration the above facts and circumstances of the case, the submissions made by the learned counsel on either side and the bad antecedents against the petitioner, this Court is not inclined to grant bail to the petitioner for the present.

Accordingly, this Criminal Original Petition is dismissed. 15.11.2024 dsn A.D.JAGADISH CHANDIRA, J.
