ORDER

The petitioners, who apprehend arrest for the alleged offences punishable under Sections 6(a), 24(1) of COTPA Act, r/w Section 123 of BNS, on the file of the respondent police seek anticipatory bail.

2. The case of the prosecution is that the petitioners are found in 1/4

illegal possession of banned tobacco products of 629 kgs worth about Rs.4,08,432/-. Hence, the complaint.

3. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are ready to abide by any condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioners.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that on regular check up by the respondent police, the petitioners are found in illegal possession of 626 kgs of banned tobacco products and these petitioners are having six previous cases pending against them. Hence, he opposed for grant of bail to the petitioners.

5. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) and perused the materials available on record.

6. Considering the gravity and nature of the offence committed by these petitioners and six previous cases are pending against these petitioners, this Court is not inclined to grant bail to these petitioners. 2/4
