ORDER

In a proposed suit in respect of alleged infringement of trade mark and passing off, the applicant/plaintiff seeks leave to sue the respondents. The applicant has invoked this jurisdiction to sue the respondents by referring to page no.1898 of volume VIII, which is the field investigation done by the applicant and the same reflects the address of the 2nd defendant as Kottivakkam, Chennai. Similarly, page no.1641 of volume VII reflects the location of the 2nd defendant is Kottivakkam, Chennai.

2. Upon considering the draft plaint and the affidavit in support of the application, it appears that at least part of the cause of action has arisen within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to the applicant to sue the respondents before this Court.
