This application has been filed to transpose the applicant as the petitioner in O.P.No.759 of 2021.

The applicant is the 8th respondent in the original application filed by the petitioner in O.P.No.759 of 2021, filed for grant of probate to execute the Will.

2. It is stated that the petitioner died on 17.10.2021 and copy of the death certificate was also produced before this Court today.

Since the applicant being beneficiary in the Will and the respondents 4, 7 and 9 have no objection and considering the fact that the Executor has died and to pursue the matter further, this application is ordered. Registry is directed to carryout necessary amendment.

The transposed petitioner has to file an application for amending the prayer in the Original Petition, besides steps to be taken to implead the legal heirs of the respondents 1 and 2, who appears to have died.
