ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences under Sec.4(1)(C), 4(1)(A) of TNP (amendment) Act in Crime No.208 of 2025 on the file of respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 26.06.2025, when the respondent police along with his team conducted a raid in Bommikuppam Village, they intercepted the petitioner, however, on seeing them, he stopped the vehicle and escaped from there. On search, they found that he was in possession of black pearl brandy and Mens club brandy 22 bottles (each 180 ml) illegally without any valid license and seized the same. Hence, the complaint.

The learned counsel appearing for petitioner would submit that he is an innocent person and he has not committed any offence as alleged in the complaint and he has been falsely implicated in this case as if he illegally transported banned tobacco products. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the respondent police seized black pearl brandy and men club brandy 22 bottles (each 180 ml) and he is arrayed as 2 nd accused.
He would submit that he is having 26 previous cases. He would submit that If 2/4
he is granted anticipatory bail, he will abscond and also tamper the witnesses and investigation is not yet completed. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Considering the above fact and circumstances of the case, and according to prosecution, he was found in possession of black pearl brandy and Mens club brandy 22 bottles (180 ml) illegally without any valid license and considering the fact that the investigation is not yet completed and on seeing his bad antecedents of having 26 previous cases and also the fact that at this stage, if he is released on anticipatory bail, he would abscond and also tamper the witnesses, this Court is not inclined to grant anticipatory bail to the petitioner.
