ORDER

The petitioner, who was arrested and remanded to judicial custody on 20.07.2025 for the alleged offences under Sections 194 of BNSS @ into Section 103 of BNS, 2023, in Crime No.272 of 2025, on the file of respondent police, seeks bail.

2. The case of the prosecution is that the petitioner conspired with the other accused and instigated them to commit the murder of her husband. The said accused persons are alleged to have murdered the deceases by strangulating him and brutally assaulting him with stones and bricks. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner, who is the wife of the deceased, has been falsely implicated in this case. He further submitted that the petitioner has been suffering incarceration from 20.07.2025. Hence, he prays for the grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that there are two accused in this case, in which the petitioner has been arrayed as A1. The deceased and A1 were husband and wife. It is alleged that A1 was having an illicit relationship with A2, and when the deceased questioned her about it, A1,

along with A2, conspired to kill him. On the day of the occurrence, while the deceased was sleeping at the bus stand, A2 committed the murder and killed him. The case is still under investigation. Hence, he vehemently opposed the grant of bail to the petitioner.

5. Considering the gravity of the offence, and the investigation is still under investigation. If the petitioner is released on bail, she may abscond, tamper with the evidence, and hamper the witnesses. Therefore, this Court is not inclined to grant bail to the petitioner.
