ORDER
This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking to withdraw H.M.O.P. No.467 of 2025 from the file of the Family Court, Trichy and transfer the same to the file of the District SubCourt, Alandur.

The petitioner is the wife and the respondent is the husband. The marriage between the petitioner and the respondent was solemnized on 02.04.2021 and out of the wed lock, one female child was born. After few years, differences arose and the petitioner and the respondent started living separately. 3.
The case of the petitioner is that the petitioner has filed a petition seeking maintenance for their daughter and herself and the same is pending and as a counter blast to the maintenance petition, the respondent has filed H.M.O.P. No.467 of 2025 before the Family Court, Tiruvallur seeking restitution of conjugal rights on the grounds stated therein. The petitioner submits that she is residing at Chennai along with her aged parents and minor child and she is entirely dependent on her parents for her expenses and she has no source of income and thus, it is difficult for her to travel to Trichy which is approximately 700 kms to attend the proceedings on every hearing date. It is further submitted that there will be no prejudice to the respondent, if the case is transferred to Alandur and sought for allowing the petition.
4. The learned counsel for the respondent submits that he has got no serious objection in allowing this petition.

In transfer petitions arising out of matrimonial disputes, the paramount consideration is the ends of justice. Where the wife is required to contest
proceedings at a distant place, the Court ordinarily leans in favour of her convenience, particularly when there is no demonstrable prejudice to the other side. Having considered the reasons stated in the affidavit and the submission of the respondent's counsel, this Court is satisfied that the transfer sought deserves to be ordered.

In the result, Tr.C.M.P. No.1007 of 2025 is allowed. H.M.O.P. No.467 of 2025 pending on the file of the Family Court, Trichy is withdrawn and transferred to the file of the District Sub-Court, Alandur. The Family Court, Trichy shall transmit the entire records in H.M.O.P. No.467 of 2025 to the District Sub-Court, Alandur within a period of three weeks from the date of receipt of a copy of this order. The District Sub-Court, Alandur shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Consequently, the interim order of stay granted in C.M.P. No.22594 of 2025 stands vacated and this petition is closed. No costs.
