Today, the case is listed under the caption ''for being mentioned'' at the instance of the learned counsel for the petitioner.
2. When the matter was heard on 28.12.2022, the learned counsel for the petitioner had made an endorsement requesting to withdraw the writ petition wherein apart from stating that they were withdrawing the writ petition, the learned counsel had set out that they may be granted liberty to approach the respondents and shall be provided with interim protection until then. However, today when the same was pointed out, the learned counsel for the petitioner confined his request with liberty to approach the respondents. The endorsement made to that effect reads as under:
"This writ petition may be withdrawn as not pressed with liberty to approach the respondents"
3. In view of the said submission made by the learned counsel for the petitioner, the 2nd paragraph of the order in W.P.No.35053 of 2022 dated 28.12.2022, is substituted with the following paragraph: 1/3
"2. In view of the endorsement made by the learned counsel for the petitioner, the writ petition stands dismissed as withdrawn with liberty to the petitioner to approach the respondents. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed."
4. Except the above modification, all other paragraphs made in the earlier order dated 28.12.2022 shall remain intact. Registry is directed to carry out necessary corrections and issue the corrected order copy to the parties forthwith. 04.01.2023 mka 2/3
