O R D E R

The review petition has been filed on the ground that the order does not make a mention about the notional promotion. When the Writ Petition had come up on 07.06.2024 what was submitted was that the petitioner had retired from the service and his retirement benefits had not been paid.

2. The Writ Petition was not contested on merits and what was prayed was that the petitioner be paid the retirement benefits. Therefore, this Court passed the order in the Writ Petition.

3. The review petition has now been filed on the ground that the interest has not been calculated and his promotion to Clerk has not been taken into consideration. The petitioner's grievance in the Writ Petition was that he was not paid the retirement benefits.

4. Therefore, questioning the calculation of his retirement benefits as if he has been promoted to the post of Clerk cannot be canvassed in the revision petition. As to the issue of interest which is the subject matter of review this Court clearly stated that amounts shall include the interest.

5. The learned counsel for the respondents would submit that all the amounts with interest has been paid.

6. In case the interest paid is less than an interest that is payable to the petitioner, it is well open to the petitioner to question the same.
