The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120B and 420 of IPC and Section 5 of Tamil Nadu Protection of Interest of Depositors (In Financial Establishment)Act 1997 in Crime No.06 of 2022 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the petitioner along with her husband approached the defacto complainant and asked him to invest money in Forex Trading Business for which they will give interest. Believing the words of the petitioner, the defacto complainant gave a sum of Rs.91,50,000/-, however the petitioner failed to give interest and the invested amount. Hence, the law enforcing agency registered a case against the petitioner.

3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence

as alleged by the prosecution and a false case has been foisted against her. Hence, he prayed to grant bail to the petitioner.

The learned Government Advocate (Crl.side) appearing for the respondent police submitted that there are three accused involved in this case, the company is arrayed as A1, the petitioner herein is arrayed as A2 and the husband of the petitioner is arrayed as A3. The petitioner along with other accused persons cheated the defacto complainant to the tune of Rs.3,28,50,000/- and as of now, 416 complaints were received from other affected persons in this case. He also raised objection stating that investigation is at crucial stage, if the petitioner is granted anticipatory bail to the petitioner, there will be possibility tampering witnesses, hampering investigation and abscondance.

5. The learned counsel for the intervenor raised strong objection for grant of anticipatory bail to the petitioner. 6.Considering the facts and circumstances of the case, the amount

involved in this case, 416 complaints were received from the affected persons, the investigation is at crucial stage and there is possibility of abscondance, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition stands dismissed. 23.01.2023 Jai/nti
