It is highly influence and voidable and illegal marriage certificate registered by 3 rd respondent and also the 3 rd respondent already married and got divorced but the register not verified properly and without proper verification, it was issued to the 3 rd respondent to declare the null and void.

ORDER

The petitioner seeks to declare the marriage certificate issued by the third respondent in HMR/Ambattur/537/2016 dated 04.11.2016 as null and void by way of this writ petition.

2. According to the petitioner, she is the first wife of one Srinivasan. Her marriage was solemnised in the year 2006 and from the wedlock, they are blessed with two children namely S.Kavin aged about 17 years and S.Samyukthaa Sri aged about 14 years. Unfortunately, her husband died on 22.02.2023, thereafter, the fourth respondent claiming to be the wife of the deceased Srinivasan has produced a certificate of marriage registered on the file of the third respondent. According to the 2 / 6

petitioner, the said marriage certificate is void, therefore, seeks a direction to the third respondent to declare the marriage certificate as null and void.

3. Counter has been filed by the third respondent. According to the third respondent, marriage between one Srinivasan and Anandi was solemnised on 14.11.2014 according to Hindu Marriage Act and marriage certificate has been registered in HMR/Ambattur/537/2016 dated 04.11.2016.

4. Heard both sides and perused the materials placed on record.

5. On perusal of the records, it appears that 4 th respondent has claimed to be wife of the late Srinivasan. She has also filed a suit in O.S.No.43 of 2023 pending on the file of District Munsif Court, Madhavaram for a permanent injunction restraining the authorities not to disburse the terminal benefits, pension and other benefits of late Srinivasan to the petitioner and other children. At the outset, this Court is of the view that as the marriage has been registered under Hindu Marriage Act, 1955, whether such marriage was valid or void, it is a matter of evidence and it has be decided only 3 / 6

by the Civil Court, the authorities cannot declare such marriage as valid or void. The very certificate sought to be annulled by the petitioner by way of a writ petition indicate that the marriage between Srinivasan and Anandhi was solemnised at Bannariamman Temple, Sathyamangalam on 14.11.2014 and later the marriage has been registered on 04.11.2016 on the file of the third respondent. Therefore, whether such marriage was solemnised during the existence of first marriage or not as to be decided only by the Civil Court.

6. Such view of the matter, I do not find any merits in this petition and accordingly, this petition stands dismissed. No costs. 02.12.2025 dhk Index :Yes/No Internet :Yes/No 4 / 6
