ORDER

Challenging the impugned order passed by the XVII Metropolitan Magistrate, Saidapet, in Crl.M.P.No.5048 of 2024, the petitioner/defacto complainant preferred this Criminal Revision Petition. 2/5

2. Before the trial court, the petitioner filed a petition under Sec.156(3) of Cr.P.C. seeking a direction to the 1 st respondent to register the F.I.R. and the same was dismissed by the trial court holding that the matter pertaining to a breach of contract between the complainant and the proposed accused, so the complainant cannot invoke criminal jurisdiction. Challenging the said findings, the complainant preferred this Criminal Revision Case.

3. Earlier, this court by an order dated 24.09.2025 directed the 1 st respondent police to conduct enquiry and to submit a report. In pursuance of the said direction, today, when the matter taken up for hearing, the learned Government Advocate (Crl. Side) submitted a report and the same was perused, wherein the proposed accused admitted the cash received from the petitioner. So, on perusal of the report, there is prima facie case attracts the allegations levelled against the proposed accused. Therefore, the 1 st respondent police is directed to register the F.I.R. as against the 3 rd respondent/proposed accused and conduct investigation within a period of four weeks from the date of receipt of 3/5
