PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of writ, order or direction, more particularly a writ of nature of Writ of Certiorarified Mandamus, to call for the records relating to impugned rejection order of 2nd respondent's order dated 15.12.2022, pertaining to rejection letter of first graduation certificate of the petitioner and quash the same and consequently direct the 3rd respondent to provide first graduation certificate to the petitioner. This Writ Petition is filed praying for a Writ of Certiorarified mandamus seeking to quash the impugned rejection order dated 15.12.2022 which was passed by the 2nd respondent pertaining to the rejection of the first graduation certificate of the petitioner.
2. Mr.P.Gurunathan, learned Additional Government Pleader takes notice for the respondents.
3. On 18.11.2022, the petitioner had approached the second respondent, by way of an application seeking issuance of the first graduation certificate, however, the said application was rejected by the second respondent vide impugned rejection order dated 15.12.2022. Challenging the same, this Writ Petition has been filed.
4. Heard the learned parties appearing for the parties and perused the materials placed before this Court.
5. It is submitted by Mr.P.Gurunathan, the learned Additional Government Pleader appearing for the respondent that the said representation of the petitioner would be considered and orders will be passed thereon in accordance with law.
6. In view of the above submission of the respondents and taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the first respondent herein to consider the petitioner's application dated 18.11.2022, on its own merits and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the third respondent to consider the representation on its own merits.
7. With the above direction, the Writ Petition stands disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed. 28.12.2022 Index : Yes / No Speaking Order : Yes / No NHS
