ORDER

This application has been filed by the respondents 1 to 3 / Judgement debtors 1 to 3 to strike off their names in the Application No.2267 of 2025 in EP (Com.Div) SD No.42694 of 2025. 2.

Heard Mr.B.Deepak Narayanan, learned counsel for the applicant and Mr.V.Ravi, learned counsel for 1st respondent and Mr.M.Devesh Kumar, learned counsel for 2nd respondent. 3.

As per the award dated 01.03.2023, paragraph 195(c) reads as follows :- "195(c) All the Respondents shall jointly and severally pay the claimant a sum of Rs.4,22,302.05/- as costs." 2/4

It is clear from the above that insofar as the respondents 1 to 3 / Judgement Debtors 1 to 3 are concerned, their liability is joint and several insofar as the payment of cost.

A memo has been filed and the relevant portions are extracted hereunder:- 4.

It is submitted that the costs portion as provided under Relief (c), together with interest comes to a total value of Rs.5,17,788.59/-. The calculation of the same is provided below: Cost awarded :

Rs.4,22,302.05/- Interest @ 9% (From 01.03.2023 to 03.09.2025) (being 2% higher than the current rate of interest u/s.31(7)(b) of Arbitration and Conciliation Act, 1996):

Rs. 95,486.54/- --------------------- Rs. 5,17,788.59/- ---------------------

It is submitted that without prejudice to the Applicant's rights and Privileges including but not limited to legal or equitable rights or right to challenge the cost portion of the Award has been complied in pursuant to the payment of Rs.5,18,000/- by way of demand draft, bearing 000762 dated 01.09.2025 to the Decree holder. The copy of the covering letter (with postal receipt / tracking) along with copy of demand draft is annexed herewith for reference.

In view of the above, it is seen that the relief granted as against respondents 1 to 3 has been complied with and therefore, the respondents 1 to 3 /Judgement Debtors 1 to 3 need not continue to be shown as parties in this application.
