The petitioners who apprehend arrest at the hands of the respondent police on 27.11.2022 for the offences punishable under Sections 9 and 10 of Prohibition of Child Marriage Act, 2006 in Crime No.680 of 2022, seek bail.

2.The case of the prosecution is that without consent, the first petitioner/A1 married a minor girl with the help of second petitioner/A3. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioners are ready to abide by any stringent conditions imposed by this Court. Therefore, he prays for grant of anticipatory bail to the petitioners.

4.Per contra, the learned Additional Public Prosecutor would submit that the petitioners are brother and sister and the first petitioner married a victim girl with the help of the second petitioner. She further submitted that the 161 statement of the victim girl is against the petitioners and the investigation is still pending. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioners. 5.Taking into account the gravity of offence and the facts and circumstances of this case, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
