The petitioner, who was arrested and remanded to judicial custody on 15.12.2022 for the offences under Sections 174 of Cr.P.C., altered to Section 306 of IPC in Crime No.294 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner/accused had love affair with the victim girl. On false promise, the petitioner sexually abused the victim girl and cheated her, due to which she committed suicide. Hence the complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he is no way connected with the alleged offences. Only on the basis of suspicion, respondent police has arrested the petitioner. He further submitted that the petitioner is suffering incarceration from 15.12.2022. Hence, he prays for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor submits that the petitioner had love affair with the victim girl. On false promise, petitioner sexually abused and cheated the victim girl, due to which the victim girl committed suicide. She further raised objection stating that investigation is at preliminary stage, if the petitioner is released on bail, then there will be possibility of abscondence and tampering of witnesses.

5. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

6. Considering the fact that investigation is at preliminary stage and the objections raised by the learned Additional Public Prosecutor, this Court is not inclined to grant the relief sought for by the petitioner. Hence, this Criminal Original Petition for bail stands dismissed. 28.12.2022 jai
