Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st respondent to allot to the petitioner the small piece of land/house site between the Plot No.79 & 80 Kurichi Housing Unit Scheme Phase-II, Kurichi, Coimbatore measuring to the extent of 1380 sq.ft in petitioner's possession as form part of Plot No.A-79, Kurichi Housing Unit Scheme - II, Kurichi, Coimbatore (allotted to the petitioner) as in the original FMB as per the recommendation of the 2nd respondent vide Letter dated 31.05.2010 as informed under Right to Information Act, 2005 in Lr.No.A4/5344/09, dated 11.11.2010 at the price

fixed and approved by the Housing Board vide Resolution dated 04.02.2010 received on 19.02.2010.

ORDER

This Writ Petition has been filed for a direction directing the 1st respondent to allot the small piece of land/house site between the Plot No.79 & 80 Kurichi Housing Unit Scheme Phase-II, Kurichi, Coimbatore measuring to the extent of 1380 sq.ft in petitioner's possession as form part of Plot No.A-79, Kurichi Housing Unit Scheme - II, Kurichi, Coimbatore (allotted to the petitioner) as in the original FMB as per the recommendation of the 2nd respondent vide Letter dated 31.05.2010 as informed under Right to Information Act, 2005 in Lr.No.A4/5344/09, dated 11.11.2010 at the price fixed and approved by the Housing Board vide Resolution dated 04.02.2010 received on 19.02.2010.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. Without expressing any opinion on merits of the writ petition,

the first respondent is directed to consider the request made by the petitioner on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
