Prayer: Writ petition filed under Article 226 of the Constitution of India, for the issuance of a Writ of Mandamus directing respondents 4 and 6 to consider the representation given by the petitioner dated 25.12.2022 for allowing the petitioner and 60 other families residing in the houses in T.S.No.894, Pudukuppam, Cuddalore Taluk, Cuddalore Town to use the pathway as public road for the ingress and egress of the general public and for those living in the quarters. With respect to the same issue, namely permission to use the pathway as a public road, in Pudukuppan, Cuddalore Taluk at Cuddalore District, a suit has also been filed and is now pending in A.S.No. 60 of 2018 before the Principal Sub Court at Cuddalore. The next hearing date is 20.03.2023.

2. In view of the pendency of the suit, it will not be proper on my part to enter into a discussion on the merits. Let the petitioner who is also a party in the appeal, concentrate on that particular appeal suit.

3. The writ petition stands dismissed. No costs. Consequently, WMP No. 34613 of 2022 is closed.
