Constitution of India, to issue a Writ of Mandamus, to direct the fifth respondents to give police protection to the fourth respondent by considering the petitioner's representation on 11.08.2025 for removal of the tin sheet shed and toilet put up by respondents 6 to 9 situated in S.No.34/13, Parugampattu Village,Thiruvennainallur Taluk, Villupuram District. O R D E R
The Writ Petition (Criminal) has been filed seeking a direction to the fifth respondent to provide police protection to the fourth respondent by considering the petitioner's representation dated 11.08.2025.
2. Heard both sides and perused the materials available on record.
3. The case of the petitioner is that he is constructing a house at S.No.34/12, Parugampattu Village, Thiruvennainallur Taluk, Villupuram District and that respondents 6 to 9 are preventing him from using the village public road. It is further alleged that they made an illegal demand of Rs.2 lakhs and when the same was refused by the petitioner, they had assaulted his mother and threatened him. Further, in front of the petitioner's 2/5
house, respondents 6 to 9 have put up a shed and constructed a bathroom at public path situated at S.No.34/13, Parugampattu Village, Thiruvennainallur Taluk, Villupuram District. Therefore, the petitioner sent representations to the authorities for removal of those encroachments and police protection. Since no action was taken on the representations, the present petition has been filed.
4. It is submitted by the learned Additional Public Prosecutor that there is an existing dispute between the petitioner and the private respondents and the proceedings under Section 145 Cr.P.C. (Corresponding to Section 164 BNSS) have already been initiated to prevent any breach of peace between the parties.
5. In such view of the matter, this Court cannot issue any blanket direction to the respondent Police to provide police protection, as the remedy sought by the petitioner lies elsewhere. The petitioner is at liberty to approach the appropriate civil court for redressal of his grievance or to participate in the proceedings initiated under Section 164 BNSS.
6. Accordingly, this Writ Petition (Criminal) stands dismissed with 3/5
the above observations. No costs.
