O R D E R

The revision petitioners are the defendants in the suit in C.O.S.No.792 of 2022, who filed an application in I.A.No.7 of 2023 to set aside the ex parte order passed against them on 09.10.2023. That application was allowed by the trial Court by imposing condition of depositing Rs.6,50,000/- in the name of the plaintiff.

2. Aggrieved by the said finding, the defendants have preferred this revision.

3. The learned counsel for the revision petitioner submits that by filing written statement, the defendants totally denied the claim of the plaintiff. Therefore, defendants is ready to deposit the amount in the suit account.

4. Heard the learned counsel appearing for the respondent and 2/4

also raised formal objection.

5. Considering the defence taken by the defendants, this Court is inclined to modify the condition by directing the defendants to deposit Rs.6,50,000/- in C.O.S.No.792 of 2022 on the file of Commercial Court, Egmore, Chennai, within two weeks from the date of receipt of copy of this order.

6. In the result, the Civil Revision Petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs. 01.12.2023 Index :Yes/No AT Note: Issue order copy on 06.12.2023 To The Commercial Court, Chennai.
