This petition has been filed to condone the delay of 444 days in filing the above appeal.

2. Learned counsel for the appellant submitted that the 1st and 3rd respondents were already set as ex-parte before the trial court.

3. In view of the above, notice to the 1st and 3rd respondents is dispensed with.

4. Mr.Michael Visvasam, learned counsel takes notice on behalf of the 2nd respondent.

5. Heard learned counsel on either side.

6. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.

7. Accordingly this petition is allowed.

Registry is directed to number the appeal, if it is otherwise in order and post the matter for admission.

8. It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, he would not be entitled to any interest for the above 444 days.
