This Criminal Original Petition has been filed seeking a direction to the first respondent to appoint Sri.S.Karthikeyan M.S.No.3299/2011 as Special Prosecutor to defend the case of the petitioner in Spl.S.C.No.9 of 2022 on the file of the Special Court (under SC/ST Prevention of Atrocities Act) District Sessions Court.

2. Heard Mr.R.Sankarasubbu, learned counsel for petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondents 1 and 2.

3. Learned Additional Public Prosecutor submitted that the request made for appointment of Special Public Prosecutor is under consideration by the District Collector and a decision will be taken within a period of two (2) weeks.

4. In the light of the above submission, there shall be a direction to the District Collector, Nagapattinam District, to take a decision within a period of two (2) weeks and ensure that the Special Public Prosecutor is appointed and he appears before the Court during the next date of hearing.

This Criminal Original Petition is disposed of with the above direction.
