O R D E R

The Criminal Original Petition has been filed seeking to quash the final report filed in S.C.No.5 of 2025, pending trial on the file of the learned I Additional Sessions Judge, Ranipet. 2.

Learned counsel appearing for the petitioners submitted that the petitioners, who are arrayed as A3 and A4 in Crime No.278 of 2022 registered on the file of the first respondent Police for the offence under Sections 294(b), 323, 324, 307, 326, 506(ii) and 34 of IPC, other than being bystanders to the occurrence, have not committed any offence as alleged by the prosecution and they are unnecessarily made to undergo the ordeal of trial. He further submitted that there are no specific overt acts attributed to the petitioners. Hence, he prayed for quashing the proceedings against the petitioners.

Learned Government Advocate (Criminal Side) appearing for the first respondent Police submitted that the petitioners are friends of A1 and A2 and that there are specific averments against these petitioners in the statements recorded from the witnesses. He further submitted that the trial 2/5

Court, finding that there are allegations against these petitioners, has framed charges on 30.06.2025. He also submitted that there are 20 witnesses in this case and the case stands posted for examination of witnesses today and the witnesses are present before the trial Court. 4.

Heard both sides and perused the materials available on record.

Considering the submissions made by the learned counsel on either side and taking note of the fact that charges have already been framed and the case is posted for examination of witnesses, this Court is of the view that the grounds raised by the petitioners are matter for trial. Hence, this Court does not find any merit in this petition, which is liable to be dismissed.

At this juncture, the learned counsel appearing for the petitioners submitted that the petitioners are ready to co-operate for speedy disposal of trial and requested that a direction may be issued to the learned trial Judge to dispose of the case at the earliest. 3/5

In view of the above, this Criminal Original Petition stands dismissed. However, the learned I Additional Sessions Judge, Ranipet, is directed to complete the trial in S.C.No.5 of 2025 as expeditiously as possible, preferably, within a period of six months from the date of receipt of copy of this order. Consequently, the connected miscellaneous petition is closed.
