O R D E R

The petitioner, who was arrested and remanded to judicial custody on 17.08.2025 for the alleged offence under Sections 296(b), 121(1), 351(3) of BNS Act and Section 3 of TN Medicare Service Persons and Medicare 1/4

Service Institutions (Prevention of Violence Damage or loss to property) Act 2008 in Crime No.453 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner herein in a drunken mood was gone to the Government hospital, Krishnagiri for getting treatment. He had abused the staff in the hospital and damaged the medical equipments, worth about Rs.57,800/-. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has not committed any such act as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner's earlier bail petition was dismissed by this Court on 04.09.2025. Hence, he opposed to grant bail to the petitioner. 2/4

5. Heard both sides and perused the materials available on record.

6. Taking into consideration the facts and circumstances of the case and the submissions made by the learned counsel on either side, the nature of offence charged against the petitioner and also taking note of the fact that there is no change of circumstances after the dismissal of the petitioner's earlier bail petition, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed. 16.09.2025 Vv To
