The petitioner seeks bail in Crime No.09 of 2023, registered by the respondent police for the offences punishable under Sections 9(m) and 10 of POCSO Act, 2012. The petitioner had been remanded to judicial custody on 12.10.2023.

2.It is stated that the victim child, who was aged about 11 year had been assaulted by the petitioner in her house on 12.10.2023. 3.It is stated that charge sheet has been made ready and would be shortly filed before the Court. The statement under Section 164(5) of Cr.P.C., of the victim child had been recorded.

4.Let the victim child depose her evidence in Court and let her also be cross-examined and thereafter, the application for bail can be considered. At this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
