C.M.P.Nos.28275, 28276 & 28278 of 2023 C.M.P.Nos.28275, 28276 & 28278 of 2023 in S.A.Nos.1620 of 2011 and S.A.Nos.1638, 1639 & 1640 of 2011 C.KUMARAPPAN, J., These civil miscellaneous petitions in C.M.P.Nos.28275, 28276 & 28278 of 2023 are filed to (i) condone the delay of 482 days in setting aside the abatement ; (ii) set aside the abatement ; and (iii) bring on records of the proposed petitioners are appellants in S.A.No.1620 of 2011 as legal heirs of the deceased sole appellant, respectively.

2. The learned counsel appearing for the respondents has made an endorsement in the aforesaid petitions stating that he has no objection to allow the petitions.

3. Having considering the submissions of the leanred counsel for the petitioner and upon the endorsement made in the petitions by the learned counsel appearing for the respondents, and also having been satisfied with the same, these civil miscellaneous petitions are allowed.

4. Post the matter on 09.01.2024.
