This Criminal Original Petition is filed to transfer the investigation in FIR No.227 of 2023 on the file of the respondent No.1 to the file of the respondent No.2 for the alleged suspected hit and run case causing death of the petitioner's son was a planned murder of three suspects. 2.

The learned Government Advocate (Crl.Side) appearing for the respondents police states that based on the information given by the petitioner herein, three suspects were enquired and it was ascertained that there was previous enmity between the deceased and three suspects, case was also registered in this regard. On enquiry, in the incident namely the accidental death of the petitioner's son, these three suspects are not involved and they came to know about the incident only after few days. 3.

The learned counsel appearing for the petitioner submits that the CCTV camera in the place of accident was not collected for investigation by the respondent police. The accident occurred on 22.04.2023 2/4

at 6.00 p.m., FIR has been registered on the next day in Crime No.227 of 2023. The representation suspecting foul in the death of his son has been made to the Deputy Superintendent of Police and Superintendent of Police after 50 days from registering the FIR.

The petitioner is the informant who has set the criminal law into motion on his complaint FIR has been registered which has initiated the investigation. At this time there is no whisper about the persons who are suspected.

On considering the submission made by the learned counsel for the petitioner and the learned Government Advocate (Crl.Side), this Court finds that it is not a case for transferring the investigation. However, needs supervision of the superior officer to ensure that there is no miscarriage of justice. Hence this Court is directing the Deputy Superintendent of Police to supervise and look into the information furnish by the petitioner and proceed.
