These petitions have been filed seeking to condone the delay of 82 days in filing petition to set aside abatement, consequent to the death of the 2 nd appellant, to set aside abatement and to bring on record the legal representatives of the deceased 2 nd appellant / Jayasimman, as appellants 3 to 5 in the appeal suit. 2.In the affidavit filed in support of these petitions, it had been stated that, the delay is neither wilful nor wanton, but only when the counsel was contacted the petitioners, they came to know that steps have to be taken, consequent to the death of the 2 nd appellant and immediately, thereafter, these petitions have been filed.
3.Heard the learned counsel for the respondents also. 4.Since the legal representatives have a right to prosecute the appeal further, we would condone the delay and allow these petitions. 5.The Registry is directed to carry out necessary amendment in the cause
title to the appeal suit.
