ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.06.2025, for the offences punishable under Sections 331(4), 305 of BNS @ 331(4), 305(a), 3(5) of BNS (Under Sections 457 and 380 of IPC @ 457, 380 and 34 of IPC) in Crime No.318 of 2025, registered by the respondent and subsequently, charge sheet filed before the learned Judicial Magistrate Court, Sriperumbudur in C.C.No.784 of 2025, seeks bail. 2.

The case of the prosecution is that the petitioner broke open the defacto complainant's house and took away 89 sovereigns of gold and 400 grams of silver ornaments. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing 2/4

for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has 16 previous cases of similar nature and no articles were recovered yet; and that the investigation is pending.

Heard the learned counsels and perused the materials available on record.

Considering the facts of the case and previous antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. 7.
