ORDER

This Criminal Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.M.P.No.11195 of 2025 in Crl.R.C.No.1280 of 2024 dated 23.08.2024 in para 5(i) as follows :- "5.(i) the petitioner shall deposit a sum of Rs.1,50,000/- to the credit of C.C.No.273 of 2017 on the file of learned Judicial Magistrate, Fast Track Court No.I, Coimbatore on or before 20.09.2024 and posted the appeal for notice to respondent on 23.09.2024. "

2. The learned counsel for the petitioner submitted that he is a widow and a retired teacher. He is ready to comply the condition imposed by this court, however, he is suffering from financial hardship and also suffering with illness. Hence, he seeks some more time for complying the condition and the present petition has been filed to modify the condition.

3. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit a sum of Rs50,000/- to the credit of C.C.No.273 of 2017 on the file of learned Judicial Magistrate, Fast Track Court No.I, Coimbatore within a week from the date of receipt of copy of this order and thereafter, he is directed to deposit a sum of 2/4

Rs.1,00,000/- (Rupees one lakh only) to the credit of C.C.No.273 of 2017 on the file of learned Judicial Magistrate, Fast Track Court No.I, Coimbatore, within a period of four weeks and he shall produce the said receipt before the court below. On such deposit, the defacto complainant is permitted to withdraw the amount on filing undertaking affidavit.

4. Except the above modification, the other conditions imposed by this Court in in Crl.M.P.No.11195 of 2024 in Crl.R.C.No.1280 of 2024 dated 23.08.2024 shall remain unalterted.
