ORDER

The petitioners, who were arrested and remanded to judicial custody on 08.08.2025 for the alleged offence under Sections 126(2), 296(b), 115(2), 109(1) of BNS Act @ 126(2), 296(b), 115(2), 103(1) of BNS Act, on the file of respondent police, seeks bail.

2. The case of the prosecution is that, due to previous enmity the petitioners and other accused persons abused and attacked the defacto complainant and caused injuries. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submits that the petitioners have been suffering incarceration from 08.08.2025. He also submitted that the petitioners are ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for

grant of bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that A2 is having 6 previous case pending against him, A3 and A4 are still absconding. He also submitted that the investigation is at preliminary level. Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking note to the gravity of offence, the investigation is at initial stage, and on considering the bad antecedents, this court is not inclined to grant bail to the petitioner.
