Though the petitioner has come up with the present Miscellaneous petition seeking to modify the order of this Court dated 12.07.2019 made in W.P.No.24959 of 2009 by substituting Rs.7,70,000/- in the place of Rs.4,71,310/- regarding the refund of EMD amount deposited by the petitioner and also the date of confirmation of the bid as 22.09.2008 in the place of 09.12.2009, however, a perusal of the records makes it clear that, this Court, vide order dated 12.07.2019 ordered for payment of Rs.4,71,310/- in favour of the petitioner, only after deducting the loss incurred by the respondent due to the failure on the part of the petitioner in depositing the entire bid amount within the notified date.

2. In view of the above, this Court is of the view that, no further modification is required in the earlier order passed by this Court and accordingly, this Writ Miscellaneous petition stands dismissed. 21.12.2023 skt 1/2 https://www.mhc.tn.gov.in/judis
