PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to dispose appeal No.1534 of 2023 filed by the petitioners as against 1/4

the order of the second respondent in letter No.5218/B5/2022 dated 26.12.2022.

ORDER

Seeking a direction to the first respondent to dispose of the appeal filed by the second respondent, the petitioners are before this Court.

2. Heard the learned counsel for the petitioners and the learned Special Government Pleader accepting notice for respondents 1 to 3.

3. The second respondent passed an order in Letter No.5218/B5/ 2022 on 26.12.2022 declaring the documents of the petitioners namely (i) sale deed dated 28.10.2011 registered as doc.No.10606 of 2011 on the file of the Sub-Registrar, Ambattur executed in favour of the second petitioner and the general power of attorney dated 15.6.2020 executed in favour of the second petitioner and registered as doc.No.5652 of 2020 on the file of the same Sub-Registrar, as fraudulent documents. Challenging the same, the second petitioner 2/4

filed an appeal before the first respondent on 22.2.2023. However, the same has not been taken up for inquiry to date. Aggrieved by this delay, the petitioners are before this Court.

Considering the limited request of the petitioners and taking note of the fact that the appeal, which has been filed on 22.4.2023, is yet to be taken up for hearing, the writ petition is allowed and a Mandamus is issued to the first respondent to dispose of the appeal filed by the second petitioner in Appeal No.1534 of 2023 within a period of four months from the date of receipt of a copy of this order. No costs.
