2. Crl.M.P.No. 17572 of 2025 has been filed by the accused/bail petitioner to extend the time limit for complying the condition in the orders passed in Crl.M.P.No.2056 of 2025 dated 07.02.2025 in Crl.O.P.No.27807 of 2024.

The learned counsel for the defacto complainant submitted that the accused/bail petitioner has not come forwarded to execute the sureties and to comply with the conditions imposed by this Court in Crl.O.P.No.27807 of 2024 dated 12.12.2024 while granting interim bail. Subsequently, when the matter in Crl.O.P.No.27807 of 2024 came up before this Court on 10.03.2025 'for reporting compliance', this Court by considering the submissions of the learned counsel for the accused/bail petitioner, extended the time for a period of two weeks to comply with the bail conditions. However, meanwhile the accused/bail petitioner by misusing the order of suspension of L.O.C. passed by this Court while granting interim anticipatory bail, came to India, but not chosen to surrender his passport or to appear before the police as per the bail conditions. Instead of complying with the conditions imposed by this Court, the accused/bail petitioner has now chosen to file a petition for seeking extension of time. Hence, the Page No.3 of 6

present petition has been filed for cancellation of interim anticipatory bail granted to the accused/bail petitioner.

4. Notice was issued to the accused/bail petitioner and on 08.10.2025, he entered appearance through his counsel and sought time for filing counter. Hence, at his request, the matter was adjourned to 14.10.2025 for filing counter. However, on 14.10.2025, the learned counsel for the accused/bail petitioner sought some more time for filing counter. Hence, the matter was taken up for hearing today (23.10.2025). Even today, the learned counsel for the accused/bail petitioner seeks further more time to file counter.

At this juncture, the learned counsel for the defacto complainant reiterated that in the order of granting interim anticipatory bail, the L.O.C. issued against the accused/bail petitioner was suspended for enabling him to return to India and to execute the bond and sureties and to comply with the bail conditions. Taking advantage of the said order, he came to India, however, he has not chosen to execute the sureties and to comply with the bail conditions. Hence, he prayed to cancel the interim anticipatory bail Page No.4 of 6

granted to the accused/bail petitioner.

6. I am of the view that there is no compliance on the part of the bail petitioner/accused and he has misused the earlier interim anticipatory bail for the purpose of L.O.C. and came to India and again returned to foreign country.

7. Considering the above facts and circumstances of the case, this Court is of the view that it is the fit case for cancellation the interim anticipatory bail.

8. Hence, the Crl.M.P.Nos.17092 of 2025 is ordered and the interim anticipatory bail granted to the accused namely Mr.Saravana Kumar, vide Crl.O.P.No.27807 of 2024 dated 12.12.2024 is hereby cancelled. Consequently, the Criminal Original Petition in Crl.O.P.No.27807 of 2024 is also dismissed.
