O R D E R

The petitioner, who was arrested and remanded to judicial custody on 16.08.2025, for the offences punishable under Sections 296(b), 324(2), 308(4) and 351(3) of BNS, 2023 (294(b), 426, 387 and 506 of IPC) in Crime No. 250 of 2025 on the file of the respondent Police, seeks bail. 1/6

2. The case of the prosecution is that on 15.08.2025, at about 9.30 pm, the petitioner along with two other accused persons had waylaid the defacto complainant and robbed a sum of Rs.310/- from him at knife point and also threatened him with dire consequences. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence however, he is suffering incarceration from 16.08.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that there are totally three accused in this case and the petitioner is arrayed as A2. He submits that due to previous enmity, the petitioner along with two other accused persons had waylaid the defacto complainant, damaged his vehicle and robbed a sum of Rs.310/- from him at knife point and also threatened him with dire consequences. He also submits that there are 10 previous 2/6

cases pending against the petitioner. Hence, he strongly opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case, nature of allegations, submissions made by the learned counsels on either side, taking into account that ten previous cases were pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
