A.No.5957 of 2024 ABDUL QUDDHOSE, J The suit has been filed for passing off.

The plaintiff claims that the major cause of action arose within the jurisdiction of this Court since the plaintiff is having its office only at Chennai and the products are sold by defendants using the plaintiff's trade mark also at Chennai. However, the defendants 1, 2, 3 and 5 are having their office outside the jurisdiction of this Court. In such circumstances, this application has been filed seeking for leave to sue the defendants 1, 2, 3 and 5.

2. This Court is satisfied with the averments contained in the plaint as well as in the affidavit filed in support of application seeking for leave to sue the defendants 1, 2, 3 and 5.

3. Accordingly, this application is allowed as prayed for.

Registry is directed to number the suit, if it is otherwise in order.
