ORDER

This petition has been filed to modify the condition No.5 imposed by the trial court in Crl.M.P.No.74/2025 dated 20.02.2025 in returning the 1/4

property of the petitioner in Cr.No.162 of 2024.

2. Learned counsel appearing for the petitioner submitted that the the learned District Munsif cum Judicial Magistrate, Karimangalam while ordering the petition under Section 497 of BNSS, 2023 for returning of car had imposed several conditions, wherein, it is the grievance of the petitioner that while imposing conditions, in condition No.5 has directed to execute a bond of Rs.5 lakhs with two sureties for the like sum each which is exorbitant as the petitioner is not wealthy and the car itself is not that worthy as it was detained for more than 1 year, therefore, seeks to relax the condition.

3. Heard the learned counsel for the petitioner and perused the materials available on record.

4. Considering the nature of the conditions imposed by the Trial Court, this Court is of the view that the condition No.5 is onerous, since, RC is also directed to be surrendered. Thus, this Court is inclined to relax the condition imposed in Crl.M.P.No.74/2025 vide order dated 20.02.2025. 2/4

5. Accordingly, the condition No.5 of the order dated 20.02.2025 is modified to the effect that petitioner shall execute a bond for Rs.25,000/- (twenty five thousand only) with two sufficient sureties for the like sum each.
