PRAYER The Writ Miscellaneous Petition (Criminal) is filed under Article 226 of the Constitution of India directing the respondents to extend the interim bail granted to the detenue, Hakkim S/o.Mohammed Malungu, convict No.4660, confined at Central Prison, Puzhal 1, in WPMP.Crl.No.32 of 2025 in W.P.No.12860 of 2020, order dated, 16.06.2025 from 17.09.2025 until further orders. ORDER
(Order of the Court was made by J.NISHA BANU, J.) This Miscellaneous Petition has been filed seeking for extension of interim bail granted to the detenu namely, Hakkim S/o.Mohammed Malungu, Convict No.466, in W.P.M.P.Crl.No.32 of 2025 in W.P.No.12860 of 2020, vide order dated, 16.06.2025, until further orders.
2. This Court, vide order dated 12.12.2024, had granted interim bail to the detenu for a period of three months, since the precess for premature release of the convict was in its final stage, based on the orders passed by the Hon'ble Supreme Court in the case of Sikkander Vs. The State and Others, Special Leave to Appeal (Crl) No.12784 of 2022. Thereafter, the petitioner filed petitions for extension of interim bail and this Court, vide orders dated 14.03.2025 and 16.06.2025 had extended the interim bail, till 17.09.2025.
3. The learned Additional Public Prosecutor submitted that the Government is considering the matter positively for premature release of the convict and further orders have not been passed so far.
4. While granting interim bail, this Court had directed the State Authorities to submit a report with regard to the prison inmate before expiry of three months. The learned Additional Public Prosecutor has produced the report of the Probation Officer dated 11.09.2025, which stated that the conduct of the detenu was good during the said period of three months.
5. In view of the above facts and circumstances, and taking note of the fact that the interim bail expires on 17.09.2025, we are inclined to extend the interim bail for a further period of eight (8) weeks, on the same conditions as imposed in W.M.P.No.39389 of 2024. Accordingly, this Miscellaneous Petition is ordered by extending the interim bail, till 10.11.2025.
6. Post the matter on 06.11.2025.
