Respondents Prayer: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to call for the records in FIR dated 09.11.2016 for an offence under Section 498-A and Section 506(i) IPC registered under Crime No.63 of 2016, on the file of the All Women Police Station at Thudiyalur.

ORDER

This petition has been filed by the accused to quash the FIR in Crime No.63 of 2016 under Sections 498-A and 506(i) IPC on the file of the All Women Police Station at Thudiyalur.

2. The learned counsel for the second respondent has submitted that after registering the FIR, the 1st respondent has transferred the same to the All Women Police Station, Thiruvarur and renumbered as Crime No.5 of 2019 on 06.05.2019 and thereafter, the investigation was done by the Inspector of https://hcservices.ecourts.gov.in/hcservices/

All Women Police Station, Thiruvarur and filed a charge sheet before the Judicial Magistrate, Thiruvarur and based on the same, a case was taken on file in C.C.No.192 of 2019 and subsequently, the said case was transferred to the Additional Mahila Court, Thiruvarur and now, the said case is pending before the said court.

3. In view of the aforesaid representation, the learned counsel for the petitioner has submitted that he may be permitted to withdraw this petition with liberty to file a fresh petition to challenge the charge sheet and he also made an endorsement to that effect.

4. Considering the same, this Criminal Original Petition is dismissed as withdrawn with liberty to file a fresh petition to challenge the charge sheet.

Consequently, connected miscellaneous petition is closed.
