The petitioner who was arrested and remanded to judicial custody on 03.09.2023 for the offences registered under Sections 294(b), 506(i) of IPC and Sections 3, 4(2), 11(4) r/w 12 of POCSO Act, in Crime No.251 of 2023, seeks bail.
2. The petitioner is aged 30 years and the victim girl is aged 15 years. Since the investigation had been completed, charge sheet should be filed shortly before the jurisdictional Court. 3.Let the trial commence. In the statement recorded under Section 164(5) of Cr.P.C of the victim girl, she has reiterated the statement made in the complaint. She must be given confidence to tender evidence. 4.Let the victim girl be examined and cross examined and thereafter, depending upon the nature of the evidence, there could be consideration of bail. At this stage, this Court is not inclined to grant bail to the petitioner.
