O R D E R

This Writ Petition has been filed challenging the official communication issued by the 2nd respondent dated 11.11.2024, thereby withdrawing the provisional affiliation granted to the petitioner institution.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner institution was initially granted recognition to run one year B.Ed Course for the academic year 2010-11 with annual intake of 100 students. Thereafter, the 2nd respondent granted affiliation to the petitioner institution by order dated 08.06.2011. Further, the petitioner was also recognised for conducting two-year B.Ed. course and granted affiliation by the 2nd respondent. By an order dated 17.05.2023, the petitioner's provisional affiliation was extended for the academic year 2023-2024 to 2025-2026.

4. The petitioner institution was inspected and 14 deficiencies were 2/6

found. The inspection was conducted on an anonymous complaint. Based on the inspection report, the petitioner was issued a show cause notice on 16.08.2024. On receipt of the same, the petitioner submitted a detailed explanation on 22.08.2024. After considering the explanation submitted by the petitioner, the Syndicate Sub-Committee resolved to withdraw the affiliation granted to the petitioner institution. It was communicated by the 2nd respondent by an official communication dated 11.11.2024.

5. The learned counsel for the petitioner would submit that the 2nd respondent has no jurisdiction to withdraw the affiliation of the petitioner institution. He would further submit that the show cause notice was issued in a mechanical manner and the impugned order was passed without considering the explanation submitted by the petitioner.

On perusal of the counter affidavit filed by the 2nd respondent and the submission made by the learned counsel for the 2nd respondent, it is revealed that the 2nd respondent did not pass the order of withdrawal of affiliation. The 2nd respondent only communicated the resolution which was resolved by the Syndicate Sub-Committee. In the impugned order dated 11.11.2024 it is clearly stated that in accordance with the decision 3/6

taken by the Syndicate Sub-Committee, the affiliation granted to the petitioner is withdrawn from the academic year 2024-2025. On the basis of the resolution passed by the Syndicate Sub-Committee, the 2nd respondent directed the petitioner that it shall not function as a college of education any more consequent to the withdrawal of affiliation and shall also not admit students to B.Ed. Degree Programme for the academic year 20242025. Therefore, the 2nd respondent did not pass any order of withdrawal of affiliation. Further, the Syndicate has the power to delegate any of its powers to the Vice-Chancellor, to a committee from among its own members or to a committee appointed in accordance with the statutes. Accordingly, the Syndicate formed a Sub Committee and the Sub Committee resolved to withdraw the affiliation of the petitioner institution. Further, though the show cause notice mentioned 14 deficiencies in the petitioner institution, the petitioner failed to rectify the same.

A perusal of the records reveals that after considering the explanation submitted by the petitioner and finding the same as unsatisfactory, the Syndicate Sub-Committee resolved to withdraw the provisional affiliation granted to the petitioner institution. Hence, this Court finds no infirmity or illegality in the Official Communication issued by the 4/6

2nd respondent dated 11.11.2024.

8. In view of the above, the Writ Petition stands dismissed. However, the petitioner is at liberty to make a representation for affiliation along with the requisite fees after rectifying the deficiencies as noted in the show cause notice dated 16.08.2024. On receipt of the same, the respondents are directed to inspect the petitioner institution and consider the request made by the petitioner. There shall be no order as to costs.
