PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the order dated 24.10.2024 issued by the 1st respondent in order No.554/2024-COMN-BR-CDA14-COM-DG transferring the petitioner from 2SIG-BN/D Coy Avadi to 2SIG-BN/H Coy Hyderabad as a terminal posting and consequential order of the 5th respondent in proceedings No.P.VII -4/2024-2 SIG-EC-1 dated 11.11.2024 and quash the same by directing the 5th respondent to allow the petitioner to continue in 2 Signal Battalion D-Company at Avadi till his superannuation (31.05.2025).

This Writ Petition has been filed to call for the records pertaining to the order dated 24.10.2024 issued by the 1st respondent in order 2/6

No.554/2024-COMN-BR-CDA14-COM-DG transferring the petitioner from 2SIG-BN/D Coy Avadi to 2SIG-BN/H Coy Hyderabad as a terminal posting and consequential order of the 5th respondent in proceedings No.P.VII -4/2024-2 SIG-EC-1 dated 11.11.2024 and quash the same by directing the 5th respondent to allow the petitioner to continue in 2 Signal Battalion D-Company at Avadi till his superannuation (31.05.2025).

The case of the petitioner is that the respondents granted promotion to the petitioner and consequently transferred him from 2Signal Bn/D Avadi to 2Signal Bn/H Hyderabad vide order No. 554/2024/COMN-BR-CDA 14-COM-DG dated 24.10.2024.

The grievance of the petitioner is that his wife is a cancer patient and taking treatment at Kauvery Hospital at Chennai and his presence is very much necessary to her. The petitioner has also made representation dated 25.10.2024 to the 2nd respondent, but the same was not considered. Hence the petitioner has filed the present petition to quash the impugned promotion and transfer order dated 24.10.2024. 3/6

During the course of the arguments, the learned Senior Panel Counsel appearing for the respondents has submitted that the request of the petitioner was considered by the respondent authorities and the petitioner's transfer was amended and he was posted /Stay at D/2 Sig Bn. The learned Senior Panel Counsel has also produced a copy of the signal dated 25.11.2024 received from the Commandant 2 Signal Bn(AOD).

4. In view of the amendment transfer orders issued by the authorities concerned, nothing survives for further adjudication in the present writ petition.

5. Accordingly, the writ petition stands dismissed as having become infrctuous. No costs. Consequently, connected Miscellaneous Petitions are closed.
