Respondent PRAYER : Criminal Original Petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the petitioners on bail in the event of their arrest pending investigation in Cr.No. 21 of 2024 on the file of the respondent police.

O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3(2)(a), 4(1) and 5(1)(a) of Immoral Traffic (Prevention) Act, 1956 in Crime No.21 of 2024 on the file of the respondent Police, seeks anticipatory bail. 1/6

2.The allegation against the petitioner is that the petitioner along with other accused was running a brothel house in Periyamedu, Chennai, in which, two victims who are aged about 26 and 13 years were rescued from the brothel house. Hence the respondent police registered a case against the petitioner herein.

3. The learned counsel for the petitioner submits that the petitioner is noway connected with the alleged offence by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that A1 is a native of Odisha and he is the owner of brothel house. Out of which, two victims who are aged about 26 and 14 years were rescued from the brothel house. He further submits that the co-accused/A2 who is a pimp, has been arrested and released on bail. However, he opposed for grant of anticipatory bail to the petitioner.

Taking into the fact that the first accused was running a brothel house and the second accused is a pimp and A2 was arrested and released on bail, two victims from the brothel house were rescued, if the anticipatory bail is granted there is possibility of petitioner indulge in similar activities, and therefore, this Court is not inclined to allow this Criminal Original Petition.
