ORDER
The petitioner has filed this Writ Petition seeking direction to the respondents 1 to 3 to select her as School Assistant in Government School in the District of Kanchipuram.
2. The brief facts of the case are that the petitioner, Tmt.Hajirama, applied for the post of Lab Assistant in Government Schools in Kanchipuram District. She belongs to the Muslim Backward Class and is physically handicapped (60% disability due to polio), and she also claims to be eligible under the inter-caste marriage quota, as she married a Hindu Adi Dravida..
3. The petitioner participated in the written test conducted on 31.05.2015 and secured 73 marks out of 150. She was shortlisted and invited for an interview, but was not selected for the post. Aggrieved by her non-selection,
she filed this Writ Petition.
4. The grievance of the petitioner is that her appointment was not considered vis-a-vis other candidates.
5. According to the respondents, the petitioner secured lesser marks compared to the candidates who were selected under the General Turn, Physically Handicapped Turn, and Backward Community (Muslim) category.
6. After the Writ Petition was filed, the fourth respondent (Mohamed Masooq K.A) who was placed above the petitioner in the selection list, was impleaded.
7. The learned counsel for the respondent submitted that the petitioner and the fourth respondent secured the same marks (73), but the fourth respondent was given priority due to his inter-caste marriage and Backward Class (Muslim) status.
8. The petitioner's application was duly considered and it was determined that the fourth respondent had additional reservations, thereby he was placed above the petitioner as per the rules.
9. For the said reasons, there is no merits in the Writ Petition and deserves to be dismissed.
10. Accordingly, this Writ Petition is dismissed. No costs. Consequently connected miscellaneous petition is closed. K.SURENDER, J.
