Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st and 2nd respondents to issue necessary direction to the 3rd respondent to give protection to the petitioners life from the illegal harassment and torture, unleashed by the police personnel attached to the 3rd respondent police station, based on his representation dated 01.10.2023 and 13.11.2023 made to the respondents No.1 and 2.

Writ of Mandamus sought for protection from illegal harassment by the police.

2. According to the petitioner, on 31.10.2023, the police man in civil dress interfered in peaceful movement, personal liberty of the petitioner and forced him to come with them. Since he raised alarm, they left in freely and this incident took inside the Court premises. It is also stated that the petitioner gave a representation to the first and second respondents but no fruitful action taken. Hence, the present Writ Petition has been filed.

3. The learned Government Advocate (Crl.Side) appearing for the respondents stated that the petitioner is a history-sheeter and he is under police surveillance. No incident as alleged by the petitioner occurred in the 2/4

Court premises or elsewhere. To avoid surveillance the present Writ Petition is filed with false allegation.

4. Without adverting to the disputed facts, the 3rd respondent police is advised to exercise their power within the parameter of law and direction laid by the Hon'ble Supreme Court, incase of keeping surveillance on a person, who is history sheeter/suspected accused.

5. With the above direction, this Writ Petition is disposed of. No costs.
