ORDER

The petitioner has filed the present petition to direct the respondentPolice to expedite the process of investigation and file final report in Crime No.422 of 2028 under Sections 120-B and 420 IPC on the file of the respondent1 / 3

Police within time frame that may be fixed by this Court.

2. The learned Additional Public Prosecutor appearing for the respondent that the de-facto complainant is not co-operating for the investigation and despite the summons having been served on them, the petitioner is not appearing and he did not even produce the required particulars/documents and therefore, in the above scenario, the petitioner is not entitled to the relief sought for.

3. In view of the above submissions of the learned Additional Public Prosecutor, the petitioner is not entitled to get the relief now sought for in this petition, and hence, this petition is dismissed. However, the petitioner is at liberty to work out his remedy in the manner known to law and in case the petitioner approaches the respondent-Police without co-operating for investigation, the respondent-Police is directed to complete the investigation and file charge-sheet/final report before the appropriate Court within a reasonable time, as expeditiously as possible.
