This petition has been filed to condone the delay of 1408 days in filing the written statement.

2.Though the delay is huge and the reasons assainged are not convincing, further, taking into consideration the fact that suit summons has not been properly served, he was set exparte, on the basis of Substitute of service, 3.This Court is inclined to condone the delay subject to the payment of cost of Rs.20,000/- payable to Adayar Cancer Institute, Chennai, on or before 29.02.2024.

4. Accordingly, this application is allowed.

5.The Registry is directed to post the main suit on 04.03.2024.
