ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for the alleged offence under Section 4(1)aaa of Tamil Nadu Prohibition Act, 1937. There are totally four accused in this case. In respect of the other accused, the mother case in C.C.No.4523 of 2002 is also pending. This case was split up in respect of the first accused and is pending as C.C.No.17729 of 2005. All the accused are said to have transported arrack that is supposed to be sold within Karnataka State to Tamil Nadu without any permit. Whatsoever, for the said allegation the case is pending for the past 23 years and non bailable warrant is pending against all the accused. 3. Under the said circumstances, absolutely, no purpose will be served in continuing the case any further. Accordingly, both the the cases in C.C.No.4523 of 2002 and C.C.No. 17729 of 2005 on the file of X Metropolitan Magistrate Court, Egmore Taluk, Chennai, stand quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
