The petitioner/A1 who was arrested and remanded to judicial custody on 14.11.2023 registered by the respondent Police for the offences punishable under Sections 279, 337, 304(ii) of IPC in Crime No.495 of 2023, seeks bail.

2.It is the case of the prosecution that on 13.11.2023, the son of the defacto complainant was going to the temple along with his wife/daughter-in-law of the defacto complainant and an infant of 6 months girl child in Volkswagon car bearing registration No.TN 37 DC 6953. At that time, the petitioner herein came in the opposite direction, driving a BMW car bearing registration No.TN 02 AV 9005. There were also four others, his friends, in the said car.

It is very specifically stated the petitioner was driving the BMW car in a rash manner and he dashed against the Volkswagon car, owing to which, the son of the defacto complainant and the small infant both died at the spot. The daughter-in-law of the defacto complainant has been admitted to the hospital and is still in critical condition.

It is the very specific case of the prosecution that the petitioner herein did not assist any of the deceased or even the critically injured daughter-in-law of the defacto complainant but ran away from the place. The other passengers were there and they were treated for some minor injuries. Thereafter, on the next day, the petitioner had also got himself admitted to the hospital.

5. I do not think that the petitioner had been admitted to the hospital for any bonafide reason. The prosecution may forward a copy of this order to that particular hospital whereever he had been admitted, since this Court is of the opinion that the Doctors there had failed in their duty as they had admitted a person who can purchase them and they were prepared to sell themselves for cheap money. This Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition stands dismissed.

7. The respondent may also forward this order to Krishna Engineering College, Coimbatore where the petitioner is studying.

8. The learned Judicial Magistrate, Avinashi may inform the said College that the petitioner herein, Siddarth S/o.Ganesh is a student of their College as an accused in Crime No.495 of 2023 registered under Sections 279, 337, 304(ii) of IPC and that by his negligent act, caused the death of two persons/ father and an infant child in an accident in which the mother of the infant child has suffered serious injuries. The said fact may be recorded in the Register of the said College and in every Certificate issued to the petitioner herein, it must be stated that he is an accused in the aforesaid crime number.
